Who is Subject to the ELD Rule?
Commercial drivers must follow the ELD rule if they are required to complete of duty status records. Aside from ensuring drivers stay in compliance and establishing the required documents, the ELD rule protects drivers from harassment from their managers based on ELD data. The FMCSA defines harassment as an action by a motor carrier towards a driver that the carrier knew would result in an hours-of-service violation, such as making a driver drive when tired. The ELD rule also provides for a driver to file a complaint per theMotor Carrier Act of 1984 . It is important to note that harassment only occurs if the action includes data from an ELD (or technology used in combination with an ELD).
Also, the ELD rule sets the performance standards as well as required ELDs to be registered with the FMCSA. In 2017, FMCSA mandated that all commercial carriers must be equipped with an ELD or face fines and possible service suspension.
